Copyright and Licensing

Introduction

This document outlines the copyright ownership, licensing terms, usage rights, and restrictions applicable to all photographic works created and supplied by GIROVISUALS (“the Photographer”). These terms apply unless a separate written agreement specifies otherwise.

Copyright Ownership

All photographs produced by the Photographer are protected under Australian and international copyright law. Unless explicitly transferred in writing, the Photographer retains full and exclusive copyright to all images. Copyright is not transferred upon purchase, download, or delivery of final images.

Licensing Overview

A range of license types are available, including Royalty-Free licensing. Details are outlined below.
When clients purchase or receive images from the Photographer, they are granted a license to use those images under specific conditions. A license outlines how, where, and for how long an image may be used.

Licenses may include:

  • Personal Use License
  • Commercial Use License
  • Editorial Use License
  • Exclusive Use License
  • Limited-Term License
  • Unlimited-Term License

Each license type defines the permitted scope of use.

Standard License Terms

Unless otherwise agreed in writing, the standard license granted is a non‑exclusive, non‑transferable license. This means:

  • The client may use the images only for the purposes agreed upon.
  • The client may not sell, transfer, or sublicense the images to any third party.
  • The Photographer may continue to use the images for portfolio, promotional, or commercial purposes.

Personal Use License

A Personal Use License allows the client to:

  • Display images in personal spaces such as homes or personal websites.
  • Share images on personal social media accounts with attribution.

A Personal Use License does not allow:

  • Commercial use
  • Resale or distribution
  • Use in paid advertising, marketing, or promotional materials

Commercial Use License

A Commercial Use License allows the client to use images for business or promotional purposes, such as:

  • Websites
  • Marketing materials
  • Social media advertising
  • Product packaging

Commercial licenses can be:

  • Single-use (one campaign or purpose)
  • Multi-use (multiple marketing channels)
  • Unlimited (broad commercial rights, priced accordingly)

Commercial licenses do not include:

  • Transfer of copyright
  • Rights for resale or redistribution

Editorial Use License

Editorial licenses allow images to be used in:

  • News publications
  • Magazines
  • Blogs
  • Educational content

Editorial use must not imply endorsement by the subjects or the Photographer.

Royalty-Free License

A Royalty-Free (RF) license allows clients to use an image multiple times for permitted purposes without paying ongoing royalties. However, it does not mean the license is free of charge.

Royalty-Free licenses typically include:

  • Multiple-use rights across approved projects
  • No time-based usage fees
  • No requirement to pay per-use or per-publication

Royalty-Free licenses do not include:

  • Transfer of copyright
  • Unlimited or unrestricted usage unless explicitly stated
  • Use in resale products (unless upgraded)
  • Exclusive rights (RF licenses are non-exclusive by definition)

Royalty-Free terms may vary depending on commercial scope, distribution volume, and media type.

Exclusive Licenses

An exclusive license grants the client exclusive usage rights for the agreed purpose and duration. During this period, the Photographer will not license the images to any other party. Exclusivity significantly increases licensing fees.

License Duration and Territory

Licenses may define:

  • Term: e.g., 1 year, 5 years, perpetual
  • Territory: e.g., Australia-only, worldwide

If no terms are specified, the default is:

  • Term: 2 years
  • Territory: Australia only

Attribution Requirements

For editorial and some commercial uses, attribution may be required. Standard attribution is:

Attribution requirements will be stated in the licensing agreement.

Prohibited Uses

Clients may not:

  • Alter images in a way that damages the Photographer’s reputation
  • Use images in defamatory, unlawful, or immoral contexts
  • Sell or license the images to third parties
  • Train AI models on the images (unless explicitly licensed)

Third-Party Rights

Clients are responsible for ensuring:

  • Model releases
  • Property releases
  • Permits

Where these are not provided, the Photographer will inform the client
whether restrictions apply.

License Upgrades

Clients may request extended or upgraded licensing at any time. Fees will reflect the new usage terms.

Copyright Infringement

Unauthorised reproduction, distribution, or use of images is a breach of copyright and may result in:

  • Licensing back‑fees
  • Legal action
  • Damage claims
